Nightmare for Canadian Costumers!? Updated

Updated............. All orders from Toydemon so far got through just fine. No trouble. Ignore the rest of this post.

The following is what I read on the Canadian Border Service Agency Website.

Why does the CBSA examine goods?
The CBSA may choose to examine your shipment for several reasons:

•to detect prohibited or restricted items (e.g. """""""""""""""""""PORNOGRAPHY""""""""""""""", narcotics) or smuggled goods;
•to fulfill the requirements of other government departments (e.g. meat inspections, import permits); or
•to ensure that the goods comply with customs legislation (i.e. to verify that the description, value, quantity and markings of the goods match the information on the invoice).

Why didn't the administrator warn me about this( the customs doesn't allow pornography to enter Canada)!? My order is probably seized by some asshole or bitch officer. Is there anyway to get it back?! If there is no way to resolve this issue. It would be my last buy from toydemon.

  It says right under international shipping to check with your local customs regulations to be aware of your country's laws.  Not Toydemon's fault.

I believe ToyDemon ships to Canada all the time, this is the first I've heard of this happening.  I have to agree with arcane1 though, it's your responsibility to know your countries laws.  I wonder if this issue is due to ILFs lawsuit...?  I didn't know pornography was illegal in Canada either... that sucks.

Dude, Why on earth world would I be aware of such an OUTRAGEOUS LAW. It's like living under a democracy and then told you don't have the right to a lawyer if you are bankrupt.

Is pornography illegal in Canada?  While I do agree that is an outrageous law, ToyDemon does try their best to let their customers know that due to the number of countries they ship to, the customer must be aware of their local and federal laws regarding products of this nature.  It would be nearly impossible for them to know all the laws in every country.  It sucks if your package did get confiscated, unfortunately it sounds like whoever inspected your package was being an asshole that day.  I hope you end up getting your stuff, good luck.   ;D

Do onaholes count as "pornography"?  The box and instructions might, but the onahole itself might not count, and therefore still be let through (if you can get TD to package the onahole in something else).  If you're really concerned about it, you could ask TD to put the onahole in something else (unless you're buying porn from them, of course).

I wonder if TD would repackage onaholes for Canadian customers if this starts becoming more of an issue?

I don't know if onaholes count as pornography, a big part of the problem is that every governmental institution defines things differently.  What pornography consists of to one person or agency is not pornography to another.  Also, it can depend on the mood/gender/time of the month, etc of the inspector who checks your packages.

Just as an added FYI the Meiki Sister series doesn't have any pornographic pictures on the packaging.

so..what exactly happened to your package??? is it just held by customs for inspection? if that's the case, you might still get it eventually...depends on how that customs agent's mood that day I suppose.... :-\

I hope so, man. I ordered it on Aug 3rd, arrived in Canadian Customs on the 13th, I still haven't seen any updates on the tracking page since. Poor lil me, I ordered Meiki Virgin and a bottle of thick TENGA lube.

thx TD. I guess I won't order any DVDs from TD now. My future purchase of hip/onaholes should probably be stripped of pornographic images just to be safe. I really hope it gets past Canadian Customs. Hopefully before mid September.  :)

I have had packages opened with sex toys opened and it's not a problem.

Only obscene material in pornography is illegal (for details check: http://cbsa-asfc.gc.ca/publications/dm-md/d9/d9-1-1-eng.pdf)

The definition is :" 18. According to the courts, material will generally fail the community standard of tolerance test if it portrays sex with violence, or if it portrays sex that is degrading or dehumanising and the risk of harm is substantial."

"22. Explicit sex that is not violent is generally tolerated in Canadian society and will not qualify as the “undue exploitation of sex,” unless it employs children in its production."

From the appendix : "2. Goods containing one or more of the following indicators may be found to be obscene and prohibited entry into Canada, if it is established that the portrayal of sex is not essential to a wider artistic, literary or other similar purpose.
Depictions and/or descriptions of:
(a) Sex with degradation or dehumanisation, if the risk of harm is substantial, e.g.
(i) actual or implied urination, defecation or vomit onto or into another person, and/or the ingestion of someone else’s urine, feces or vomit, with a sexual purpose, excluding consensual urine onto another person;
(ii) ridicule and/or humiliation
(b) Sex with pain
(c) Sexual assault
(d) Sex with violence
(e) The taking of a human life for the purpose of sexual arousal
(f) Incest
(g) Bestiality
(h) Necrophilia
Note: Depictions and descriptions of sexual activities involving children and/or juveniles (persons under the age of 18) will generally constitute child pornography."
 

The most important for ordering sex toys:

So for sex toys, you should not have any problems (unless there are images contrary to these regulations). Thx for the info, even if that's the case, I still may have a little problem. I ordered Meiki Virgin Aoi Chihiro, which is a miniture replica... they might mistaken it for the replica of an underaged girl.... damnit. I should have ordered Meiki ZXY or Maria Ozawa or sth...

I just found out that if Canada Customs find something obscene, they won't return it, they will simply dispose of it.
